AI Disclaimer

Some of our digital products, including designs, clipart, seamless patterns, alphas, and mockups, may incorporate AI-generated elements as part of the creative process. While AI may contribute to certain aspects of our designs, all final products are carefully curated, enhanced, and formatted to meet professional standards before being made available for sale.

Intellectual Property Disclaimer

Kayndi Designs creates unique and original graphics, designs, and resources. Along with our own artwork, we also use licensed clipart and elements, which we carefully edit, enhance, and incorporate into completed design pieces.

Any unauthorized reproduction, redistribution, or resale of our digital files is strictly prohibited. Purchasing a file grants the buyer a limited, non-exclusive license to use the digital assets under the terms outlined below but does not transfer ownership or intellectual property rights.

Trademark Responsibility Notice

Buyers are solely responsible for ensuring that any words, phrases, or images used in their commercial products do not violate existing trademarks. Before selling any physical products using our designs, buyers must conduct their own trademark searches through the United States Patent and Trademark Office (USPTO) database or other applicable trademark authorities.

Kayndi Designs does not guarantee or warrant that any design is free from trademark restrictions. We are not liable for any trademark disputes or legal issues that arise from the use of our designs on products intended for resale.

License & Usage Rights

The purchase of a digital file from Kayndi Designs grants the buyer a non-transferable, non-exclusive license for personal and small business use in accordance with the following terms:

Permitted Uses

• Use the design on personal projects or small business products for resale (e.g., printed apparel, tumblers, decals, stickers).
• Print and sell physical items using the design (unlimited quantities allowed).
• Modify designs for personal use only (text overlays, background changes, etc.).

Prohibited Uses

• Reselling, distributing, or sharing the digital file in any form (including as part of clipart packs or bundles).
• Modifying the design and reselling it as a digital product.
• Using designs for print-on-demand (POD) services (Printful, Printify, Redbubble, etc.) without purchasing an Extended POD License.
• Selling printed transfers of the design without purchasing a Printed Transfer License.
• Claiming our designs as your own or falsely representing authorship.

Additional Licensing Requirements

If you intend to sell printed transfers or use our designs for print-on-demand services, you must purchase the appropriate license:

1. Printed Transfer License – Required if selling printed transfers of our designs.
2. Extended POD License – Required if using designs with Printful, Printify, Redbubble, or similar services.

Lifetime Drive Holders & Active Membership Exemptions

• If you purchased a lifetime drive (we no longer offer lifetime drives), you do not need to purchase a Printed Transfer License or Extended POD License, as lifetime drive holders have full licensing included.
• If you are an active Creators Klub member, you do not need to purchase a Printed Transfer License or Extended POD License as long as your membership remains active.
• If you cancel your membership and plan to continue selling printed transfers or using a POD service, you mustpurchase the correct Extended License to remain compliant.

Watermark Protection

• All products must include a visible watermark when shared or displayed publicly to protect the artist’s work.

Single User License

• Files are licensed for use by one individual or business.
• Sub-licensing, reselling, transferring, or redistributing files in their original format is strictly prohibited.

Intellectual Property Acknowledgment

• All designs remain the property of Kayndi Designs.
• Buyers do not acquire ownership rights to the designs or their elements, regardless of modifications.

Prohibited Uses

• No files may be resold, redistributed, or included in digital or printed bundles for resale.

Liability Disclaimer

• Kayndi Designs is not liable for misuse, damages, or losses arising from the improper use of its products.

Compliance Responsibility

• Users are solely responsible for ensuring their use of Kayndi Designs' products complies with all applicable laws, regulations, and licensing requirements.

Refund Policy

Due to the nature of digital products, all sales are final. No refunds, cancellations, or exchanges will be issued once a purchase is completed. Please ensure compatibility before purchasing.

By purchasing and downloading any digital file from Kayndi Designs, you acknowledge that you have read and agreed to these Terms of Use.

Personal Use:

• Designs may be used in personal projects or crafts without limitations.

Commercial Use:

• Designs may be used for small business printing needs, including physical products such as shirts, tumblers, and stickers.
• No quantity limits apply to physical product creation.
• Modifications are limited to adding text or backgrounds for physical product sales only.
• Digital sales or reselling designs in any altered form is prohibited.
• Designs may not be used for print-on-demand (POD) services unless an extended POD license is purchased.

Licensing Options:

• Vault Membership: Vault members do not need to purchase a Printed Transfer License as long as their membership remains active. If the membership is canceled, a full shop transfer license must be purchased to continue selling printed transfers.
• A Printed Transfer License is required to sell printed transfers for non-members.
• An Extended POD License is required for using designs with services like Printful, Printify, and Redbubble, regardless of Vault Membership status.

• Files must be incorporated into completed designs that cannot be extracted by another user.
• Products for sale must be flattened before distribution.

• May not be offered for sale on stock resource websites.
• Must not be included in customizable digital files where elements are extractable.
• May not be turned into fonts to be sold digitally.

• Brushes and digital stamps may not be resold or redistributed as-is in any format.

• No restrictions on the number of products created.

Restrictions:

• Mockup images may not be resold or redistributed as-is.
• Files cannot be used with print-on-demand websites.
• Must not be offered as part of a standalone or bundled file.

If a member cancels their membership, they will continue to have access to member content until their next rebilling date.
